and since there are very few hospitals that do not accept medicare or medicaid, there shouldn't be a big problem.

What's funny is at my nursing home, we have several people who have non family members who are POAs.  They have family members, but they are not the POA.

While it's a start, it's long over due for Obama to initiate this. Presumably it wasn't an issue during the Clinton years (Bush probably would bother).

Devil is going to be in the details. The article quotes the memo "In the memo, Obama said hospitals should not be able to deny visitation privileges on the basis of sexual orientation or gender identity. "

Don't be surprised if hospitals still ban non-relatives (ie not legally married or legal civil union) from patients who are unable to give positive assent.  From the news article, it seems that Langbehn would still have been shut out as I don't think they were married nor from a state with a civil union law.

It surprises me also.
I'd think that sueing the hospital over not following the POA would stop that without having to write a new regulation. Guarentee that some conservative Christian will be denied visitation as a non-close relative and not having a POA to raise a media ruckus.

Sexual orientation shouldn't matter if there is a POA, legal marriage or legal civil union.
