was that before or after the formation of west virginia, that that was in the constitution?

It's been in the constitution from the start. Virginia was technically wasn't a state (as it had seceded) when West Virginia was created --or at least that was some of the the reasoning used to justify its creation

As along as the rest of the state doesn't mind, you actually could. The Constitution prohibits Congress from forming new states from the territory of other states -- unless the original state agrees with it. So convince the rest of NY that they don't want you. Smiley
