Seeing as "free men" was probably a reference to "not a slave", it seems pretty clear it would have to be updated for modern times, what with the colored folk and the womenfolk all being "free men" nowadays.  Besides that, you can't base interpretations of the law on the Founders' 18th century concepts of mind and personhood, seeing as they were, though educated for the times, pretty ignorant about it; you have to take modern scientific findings into account.

Well, you couldn't be an indentured servant either. And btw, whites are no longer slaves either.

Well, seeing as indentured servitude is essentially leasing a slave, no, you couldn't.  Although what you mean by "whites are no longer slaves either," I don't know; I wasn't aware there'd ever been white slaves in the American Colonies, other than indentured servants.

Basically, if your mother was a slave, you were a slave no matter what your father's status was.  So if you have a few generations of master-slave mating, then you would get slaves who look white.

To use a more concrete example, Sally Hemings was only 1/4 African (her maternal grandmother).  The children of hers and Thomas Jefferson* were said to have passed as white (which would make since as they would have mostly European ancestry).

* Well, more than likely they were his.  DNA has proven that there was a Jefferson involved somewhere.

WAY off topic, but the original people enslaved in the Americas by white masters were native.

And to take off from Mel's post, the story "Desiree's Baby" by Kate Chopin makes interesting reading.
