Read the court order striking down the mandate and the entire law.

Likewise, read the two court orders that said this was constitutional.

Until this hits the USSC, there's no real good way of debating this based on court decisions.

Well, Koi could debate it, but most of us don't have enough training to do so in a significant manner.

Virginia has asked the USSC to review it and skip the appealate court phase. This is important in light of the Florida decision striking down the entire law, rather than just the mandate section. With the entire law gone, nobody in the govt is allowed to spend money implementing it.

An activist judge with an axe to grind looking for an excuse to hurt someone he doesn't like isn't exactly the best choice to read the Constitution for what it says.

Actually, my point was that whichever side you come down on you have a court case to cite.

That's two for and two against. I assume we'll eventually see this one up at the USSC.

Actually, I think I was wrong. That was 2 for and 1 against. After yesterday's ruling, it's 3 for and 1 against.

I have to admit, though, that yesterday's case had a twist I'd never thought of...religious freedom.

Uh, no.

2 against (Florida and Virginia)
2 for (Michigan? & ?)
1 dismissed (Washington)

I suspect that this case isn't all that different than when the Amish had their property confiscated for not paying Social Security tax.

OK. Then I misremembered this morning. Regardless, there's no consensus on this, so we all get to play the wait and see game until the USSC weighs in.

Got some more news, please move to correct thread. don't have time to properly do this.

http://whitehouse.blogs.cnn.com/2011/02/23/attorney-general-declares-doma-unconstitutional/

this is a Minor win on the issue. not a Major change. more comment later.
